Most Topsail Island pool projects that go sideways do not go sideways during construction. They go sideways in the eight weeks before it, when nobody mapped the permit path, nobody tested what the water table was doing on that specific lot, and the barrier requirements got treated as something to solve after the deck was poured.
Building a pool on Topsail Island is a genuinely different project from building one ten miles inland in Pender or Onslow County. Three towns with three permit desks, two counties, a state coastal permitting layer that does not apply on the mainland, sandy fill to full excavation depth, and a water table that can sit within a few feet of the surface. None of that is a reason to avoid the build. It is a reason to know what you are walking into before you sign anything.
Here is what the process actually looks like.
Three Towns, Two Counties, Three Sets of Rules
Topsail Island is not one jurisdiction. It is three towns spread across two counties, and your pool permit path depends on which one your lot sits in.
- Topsail Beach at the south end sits in Pender County.
- Surf City in the middle straddles the Pender and Onslow county line, which means two otherwise identical lots a few blocks apart can answer to different county offices.
- North Topsail Beach at the north end sits in Onslow County.
Every in-ground pool build needs a building permit and an electrical permit, plus zoning review against setbacks, easements, and lot coverage limits. If your property sits in an HOA or a planned community, add an architectural review submission on top, and those review calendars run on their own schedule regardless of what the town does.
The practical consequence: a builder who works mostly in Jacksonville or Wilmington and takes an occasional island job is learning your permit path on your timeline. That is where the surprise weeks come from.
When CAMA Enters The Picture
This is the layer most homeowners do not see coming. North Carolina’s Coastal Area Management Act regulates development inside designated Areas of Environmental Concern, and a swimming pool is development.
Your lot is likely inside an AEC if it falls into any of these:
- Within 75 feet of the normal high water line along an estuarine shoreline (the sound side of the island, and this one catches a lot of Surf City and North Topsail Beach lots)
- On or adjacent to coastal wetlands or marsh
- In the ocean hazard area near the beach or an inlet
- Within 575 feet of the shoreline of Outstanding Resource Waters
If you are inside an AEC, the project needs a CAMA minor permit issued through the town’s Local Permit Officer. As a reference point, Cape Carteret on the mainland side of our service area publishes a $100 application fee and a statutory decision window of 25 days from receipt, extendable by another 25 days if the officer needs it. Budget accordingly, and understand that the clock starts when the application is complete, not when you first walk into the office.
On an oceanfront lot there is a second constraint: the oceanfront construction setback. It is measured landward from the first line of stable natural vegetation, and for structures under 5,000 square feet the setback is 60 feet or 30 times the erosion rate setback factor, whichever is greater. The minimum setback factor applied is 2, and it climbs on stretches of shoreline with higher long-term erosion rates. On a narrow oceanfront lot, that line frequently decides where the pool can physically go, and it decides it before anyone draws anything.
The sound-side version of the same problem is the 75-foot estuarine shoreline AEC, which on a lot of Topsail lots runs directly through the part of the yard with the view you actually want to swim in.
This is solvable. It just has to be solved at the site-walk stage, not after you have fallen in love with a rendering.
The Water Table Is The Real Engineering Constraint
Island fill is sandy through the full excavation depth, with real variation lot to lot, and groundwater can sit within a few feet of grade. Two things follow from that.
First, during construction. Excavation on a high-water-table lot may need active dewatering to keep the hole workable while the shell goes in. That is a line item, and it should appear in the proposal rather than showing up as a change order in week two.
Second, and more importantly, for the life of the pool. Groundwater exerts upward force on anything buried in it. A full pool is not at risk: the weight of the water inside balances the pressure outside. The risk shows up when the pool is empty or badly drawn down, which is exactly when someone decides to drain it for a resurface, a repair, or after a storm.
Two build-stage details handle this properly:
- Hydrostatic relief in the shell floor, sized for coastal conditions, so groundwater has a controlled path rather than a structural one.
- A dewatering well beside the deep end. The standard version is an 8-inch PVC pipe run to the bottom of the excavation outside the shell, surrounded by clean gravel so water moves freely into it, cut flush with the deck and capped with a skimmer lid. When the pool ever needs to come down, you drop a pump in it for a few days first and pull the water table down before you touch the pool.
Installing that well during the build takes under half an hour and costs almost nothing. Retrofitting the same capability into a finished deck later costs orders of magnitude more. Ask whether it is in the scope.
The rule that follows: on a coastal lot, nobody drains the pool without pumping the groundwater down first. Not the cleaning service, not a contractor, not you.
Barrier And Safety Code Belong On The Site Plan
North Carolina adopts the residential barrier requirements from the building code, and the working numbers are:
- Barrier at least 48 inches high, measured from the outside
- No opening that allows a 4-inch sphere to pass
- Chain link mesh openings no wider than 1 3/4 inches
- Gates self-closing and self-latching, swinging away from the pool
- Latch release at least 54 inches above grade on the pool side, or positioned so it cannot be reached from outside
Add code-compliant anti-entrapment drain covers, and electrical bonding and equipment grounding per the electrical code, specified with corrosion-resistant hardware because the island will find any fastener that is not.
The reason this belongs in design rather than in the final inspection is space. A 48-inch barrier added to a finished backyard eats deck, forces awkward gate placement, and often ends up running through the middle of the sight line the whole project was built around. Drawn at the site-plan stage, it disappears into the hardscape and nobody ever notices it.
A Realistic Timeline
Rough planning numbers for an island build, assuming nothing unusual:
- Consultation and design: 2 to 4 weeks. Lot walk, sight lines, setbacks, renderings, finish selections, fixed-scope proposal.
- Permitting: 4 to 10 weeks realistically. County building and electrical permits, zoning review, a CAMA minor permit if you are in an AEC (25 days statutory, extendable), and HOA architectural review if applicable. These do not all run in parallel.
- Construction: excavation, plumbing, steel, shell, tile, coping, deck, equipment, finish, startup. Weather moves this. Named storms move it more, and hurricane season overlaps the part of the year everyone wants to build in.
The takeaway for anyone who wants water in the pool by Memorial Day: the project starts in the fall or early winter, not in March. Islands book out, permit desks queue up, and the good crews are committed months ahead.
What To Ask Before You Sign
Five questions that separate builders who work on the island from builders who occasionally visit it:
- Which AEC is this lot in, and does this project need a CAMA minor permit? A builder who has to look it up later has not walked the permitting on your lot.
- What is your dewatering plan during excavation, and is a dewatering well included in the scope?
- What hydrostatic relief is specified for this shell, and is it sized for our water table rather than a standard inland detail?
- Where does the barrier run on the site plan, and how does the gate work with the deck layout?
- What hardware, coping, and equipment specification changes because this is direct salt-air exposure rather than a mainland lot?
If the answers are specific, you are talking to someone who builds here. If they are general, the specification is inland and the failures will show up in year three.
